These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and LOONEVO LTD (trading as "Loonevo"), a company registered in England and Wales under company number 16984595, with its registered office at Unit A, 82 James Carter Road, Mildenhall, IP28 7DE, United Kingdom ("we", "us", "our"), governing your access to and use of the website loonevo.com (the "Site") and the purchase of products offered through it.

By accessing, browsing, creating an account, or placing an order on the Site, you agree to be bound by these Terms, our Privacy Policy, Refund & Returns Policy, Shipping Policy, and any other policies referenced herein. If you do not agree, you must not use the Site.

1. Eligibility

You must be at least 18 years old or the age of majority in your country of residence to place orders on the Site.

By using the Site, you confirm that you have the legal capacity to enter into a binding contract.

2. Account Registration

If you create an account, you agree to:

  • Maintain confidentiality of login credentials

3. Products and Orders

  • Cancel orders due to stock shortages, suspected fraud, or legal compliance reasons

Placing an order constitutes an offer to purchase.

A binding contract is formed only when:

  1. You receive an order confirmation email; and

  2. The goods are dispatched.

If an order is canceled after payment, you will receive a full refund without undue delay.

4. Pricing and Payment

  • Prices are displayed in the currency selected at checkout.

  • VAT is included where required by law.

  • International customers may be responsible for customs duties, import taxes, or clearance fees.

Payment is processed securely through third-party providers.
We do not store full payment card details.

You authorize us and our payment processors to charge your selected payment method at checkout.

5. Shipping, Delivery, and Risk

Shipping methods, costs, and estimated delivery times are detailed in our Shipping Policy.

Delivery times are estimates and not guaranteed. Delays may occur due to carriers, customs, or force majeure events.

Risk of loss passes to you upon delivery to the address you provide.

Nothing in this section affects your statutory rights regarding delivery of goods.

6. Right of Withdrawal (EU & UK Consumers)

If you are located in the European Union or the United Kingdom, you have a statutory right to withdraw from your purchase within 14 calendar days from receipt of the goods.

This right is governed by:

  • Directive 2011/83/EU

  • Consumer Contracts Regulations 2013

Nothing in these Terms limits your mandatory consumer rights.

7. Legal Guarantee

If you are a consumer in the EU or UK, you benefit from statutory guarantees under applicable consumer protection laws, including:

  • Directive 2019/771

  • Consumer Rights Act 2015

These rights are not affected by these Terms.

8. Intellectual Property

All content on the Site, including text, graphics, logos, images, product designs, branding, and software, is owned by LOONEVO LTD or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or exploit any content without prior written permission.

9. Acceptable Use

You agree not to:

  • Attempt unauthorized access to systems or data

10. Limitation of Liability

To the fullest extent permitted by law:

  • Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence

  • Fraud or fraudulent misrepresentation

  • Any matter where liability cannot legally be excluded

This clause does not affect your statutory consumer rights.

11. Indemnification

You agree to indemnify and hold harmless LOONEVO LTD from claims arising from:

  • Your breach of these Terms

  • Your misuse of the Site

  • Your violation of third-party rights

This does not apply to consumers exercising statutory rights.

12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of England and Wales.

However, if you are a consumer residing in the European Union, you will also benefit from any mandatory provisions of the law of your country of residence.

Nothing in these Terms deprives you of the protection afforded by mandatory consumer protection laws in your jurisdiction.

Consumers may bring proceedings either in:

  • The courts of their country of residence; or

  • The courts of England and Wales.

13. Alternative Dispute Resolution

If you are an EU consumer, you may access the European Commission’s Online Dispute Resolution platform established under:

Regulation (EU) No 524/2013

14. Force Majeure

We are not liable for delays or failures in performance caused by events beyond our reasonable control, including natural disasters, strikes, pandemics, supply chain disruptions, or governmental actions.

15. Changes to These Terms

We may update these Terms from time to time.

Material changes will be posted on the Site with a revised effective date and, where appropriate, notified via email.

Continued use of the Site constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
